1. Introduction

Welcome to thetartanartisan.com, operated by Steven Patrick Sim t/a The Tartan Artisan® (“we”, “us”, or “our”).
These Terms of Service govern your use of our website and the purchase of any products or services, including those produced or dispatched through approved fulfilment partners: Print Space Studios Limited, Contrado Imaging Ltd, and Glenisla Kilts Ltd.

By accessing or purchasing through this website, you acknowledge and agree to be bound by these Terms, along with our Privacy Policy, Returns & Refund Policy, Shipping & Delivery Policy , Cookie Policy, and other linked policy documents forming part of our Legal Framework.
If you do not agree, please discontinue use of the site before making a purchase.

3. Our Products and Services

Declaration of Arbroath Burnished Gold Editions: unframed Black Onyx, Pewter and Pearl prints in Collector and Life-Size formats, printed, numbered, certified and packed by hand in Arbroath, with DHL delivery quoted at checkout where available.
Original artworks and artisan goods, produced and shipped directly from our studio.
Made-to-measure kilts and Highland wear, crafted in Scotland in partnership with Glenisla Kilts, inspected and dispatched by us.
Additional Highland wear and accessories, supplied by trusted Scottish manufacturers acting on our behalf, without receiving customer-specific sizing data.
Specialist framed Declaration artworks, including Declaration 3D Fine Art Facsimiles and legacy framed Declaration Gold Metallic Print Editions, produced, finished, framed, collected, delivered, or quoted through specialist arrangements involving The Tartan Artisan® and trusted framing partners such as Aizle Framing, Balfron.
Fine-art prints and framed editions, fulfilled by Print Space Studios Limited (UK, EU & US production sites).
Print-on-demand products, manufactured and distributed by Contrado Imaging Ltd, London.
Each product listing clearly states the associated fulfilment route and relevant production partner.

4. Contract Formation

Your order is an offer to buy. An automated acknowledgement confirms that we have received it; acceptance occurs when we expressly confirm acceptance or confirm that production of your order has begun. A dispatch confirmation also constitutes acceptance if we have not accepted the order earlier.

Before acceptance, we may decline an order if the item is unavailable, payment is not authorised, there is a material pricing or description error, or fulfilment would be unlawful or impractical. We will explain the issue and refund any amount paid for an order we decline.

Once an order is accepted, its agreed price will not be increased without your agreement. If we cannot supply an accepted order, we will contact you to agree a solution or provide any refund to which you are entitled.

5. Prices, Taxes & Payments

All prices are listed in GBP (£) and include UK VAT where applicable.
VAT and any taxes collected through checkout are shown before payment. Export VAT treatment depends on the applicable rules and fulfilment route. Destination import duties, taxes and clearance fees are payable by the customer unless expressly included in the checkout or an agreed written quote.
We securely process payments via Shopify Payments, PayPal, and Stripe. We never store your payment card details.
The applicable product price and any delivery charge are shown before you commit to purchase; an accepted order price is not changed without agreement.
Pricing, taxes, or offers may vary due to supplier networks or currency fluctuations.

By placing an order, you confirm that you are authorised to use the selected payment method and that the payment, deposit, or agreed initial amount will be processed at the time of ordering.

Deposit, Reservation and Balance Payment Orders

Burnished Gold Editions: where offered, you may choose full payment or a 25% product deposit through Downpay. Checkout shows the amount due now, the remaining balance and any delivery or tax amounts; these do not necessarily divide in the same proportion as the product deposit. The balance is due before dispatch. The payment method used for a deposit order is held securely by the payment service for an authorised balance payment, or we may send a balance-payment request. We do not dispatch a partially paid order.

Some specialist artworks and higher-value products may be offered with a reservation deposit or part-payment option at checkout. For example, the Declaration of Arbroath Fine-Art 3D Facsimile — 7th Centennial Edition may be offered with a £440 reservation deposit due at checkout and, at the current £1,320 product price, a £880 remaining balance due before completion, collection, delivery, or fulfilment.

A reservation deposit is a partial payment toward the full product price. It is not a separate product, loan, finance agreement, or credit facility.
The full product price remains payable unless the order is validly cancelled in accordance with our Returns & Refund Policy.
The remaining balance, together with any agreed delivery, insurance, packing, or custom shipping charge, must be paid before the item is released, collected, dispatched, delivered, or marked fulfilled.
Where checkout or the order confirmation refers to a balance due “on fulfilment”, this means the balance will be requested or collected before final release of the order, in line with the payment method and fulfilment process used.
If a balance remains unpaid after reasonable notice and reminders, we may cancel the order and release its reserved edition number or production slot. Any refund or lawful deduction follows the Returns & Refund Policy; a deposit is not automatically forfeited.

6. Fulfilment & Delivery

We use multiple fulfilment routes for efficiency and sustainability.

Burnished Gold Editions — Studio Production and DHL Delivery

Please allow 5–7 working days from receipt of your deposit or full payment, subject to stock availability, for production and preparation. DHL transit time is additional. Delivery is calculated for your address and order at checkout where the service is available; any applicable remote-area surcharge is included in that delivery quote. If no suitable rate appears, contact us before ordering. Special requests are welcome before purchase.

a. Other Studio-Fulfilled Items

Shipped via Royal Mail or DHL depending on destination and value.
Shipping may be invoiced separately or included at checkout.

b. Made-to-Measure Kilts

Custom-made garments are excluded from the 14-day cooling-off period under Consumer Contracts Regulations 2013 (Reg. 28(1)(b)), except where faulty or not as described.
Lead time: typically 8–12 weeks. Orders shipped via DHL Express with tracking provided; any additional shipment protection is arranged for the relevant order.

c. Fine-Art Prints (Print Space Studios Limited)

Print orders are automatically fulfilled through theprintspace to minimise carbon impact.
Prints are produced locally within the nearest lab (UK, EU, US) for efficiency and reduced customs intervention.

d. Print-on-Demand Products (Contrado Imaging Ltd)

Products created to order using sustainable production.
Dispatch typically 1–3 business days, delivery determined by courier region.

e. Specialist Framed Declaration Artworks

Specialist framed Declaration artworks, including the Declaration 3D Fine Art Facsimiles and legacy framed Declaration Gold Metallic Print Editions, require careful handling and may involve collection from Aizle Framing, Balfron, eligible local/regional Aizle delivery, or a custom delivery quote. Where a deposit or reservation option is used, the full balance and any agreed delivery charge must be paid before collection, dispatch, delivery, or fulfilment.

Important framed-artwork checkout note: if checkout shows Customer collection from Aizle Framing, Balfron, Customer collection only from Aizle Framing, Balfron, or a similar £0.00 / “FREE” shipping line, this means customer collection by appointment only. It does not mean free delivery. Eligible local/regional postcodes may also be offered Aizle local/regional framed artwork delivery at £49. Other delivery arrangements require a custom quote before dispatch.

7. Returns, Refunds & Cancellations

Cancellation and return rights depend on whether the goods are standard products or genuinely made to your specifications or clearly personalised. Printing an existing design to order, issuing a standard certificate, or allocating an edition number does not by itself remove the statutory cancellation right.

Standard Burnished Gold prints: online consumer orders have the statutory cancellation period described in our Returns & Refund Policy, including orders paid with a deposit.
Studio stock items: our additional 30-day voluntary return offer applies subject to its stated conditions, alongside statutory rights.
Other standard fine-art and print-on-demand products: statutory cancellation and faulty-goods rights apply; using a fulfilment partner does not reduce those rights.
Genuinely bespoke or clearly personalised goods: the statutory change-of-mind exemption may apply. Any cancellation arrangement will be explained before purchase. Faulty, damaged or misdescribed goods remain protected.
Deposits and framed Declaration orders: paying a deposit, reserving a number, or choosing standard framing does not automatically make an order non-refundable. Any lawful charge for cancellation outside a statutory right must be fair, proportionate and based on actual loss, taking account of the ability to reuse or resell the goods.

8. Accuracy of Information

We take care to describe items accurately; however, minor variations may occur.

Colours and materials may differ due to screen settings or textile batch variations.
We correct typographical, pricing or description errors promptly. If an error affects your order, we will contact you; your statutory rights and any agreed contract terms remain protected.

9. Intellectual Property

All website material, including text, tartans, imagery, product layouts, and logos, is owned by Steven Patrick Sim unless otherwise stated.
No content may be reproduced, sold, or adapted without express written consent.

10. Acceptable Use

Visitors agree not to:

Use the site for unlawful, defamatory, or harmful purposes.
Copy, resell, scrape, or misappropriate our content.
Circumvent or exploit website software or security measures.
Infringe copyright, trademarks, or design rights.

We reserve the right to suspend access or pursue legal recourse where misuse is identified.

11. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your statutory consumer rights.

Where we breach the contract or fail to use reasonable care and skill, we remain responsible for loss or damage that was reasonably foreseeable when the contract was made. We do not exclude your legal remedies for faulty goods, misdescription, non-delivery or late delivery.

The carrier or fulfilment partner used does not remove our responsibilities to you as the seller.

12. Force Majeure (Events Beyond Control)

We are not responsible for any delay or non-performance caused by circumstances reasonably beyond our control, including but not limited to:
weather disruption, courier failure, labour disputes, acts of war, or digital outages.
In such events, we will notify you promptly and seek the fairest possible resolution. Your applicable delivery, cancellation and refund rights remain protected.

13. Data Protection

Your personal information is handled lawfully in accordance with the UK GDPR and Data Protection Act 2018.

14. Dispute Resolution

If a dispute arises, we aim to resolve it promptly and fairly.
Contact: enquiries@thetartanartisan.com for mediation or complaint handling.
If we cannot resolve a complaint directly, you may seek independent guidance from Citizens Advice Scotland or pursue any legal remedy available to you. Where required, we will identify an appropriate alternative dispute resolution provider and tell you whether we will participate.

Nothing restricts your statutory consumer rights under Scots or UK law.

15. Governing Law & Jurisdiction

These Terms and contracts are governed by Scots law, subject to mandatory consumer protections that apply to your purchase. Scottish courts may hear disputes, but a consumer may also use any court to which they are legally entitled to apply. International sales remain subject to any mandatory protections applicable to the customer.

16. Updates to These Terms

We may update this document periodically for legislative or operational changes.
The latest version will always appear on this page, showing the applicable Effective Date.
Updated Terms apply to future orders. Changes do not retrospectively alter an accepted order unless agreed or required by law.
